UAE Labour Law Amendments: Enhanced Penalties and Strengthened Employee Protections in 2024

In 2024, the UAE government introduced significant amendments to the UAE Labour Law through Federal Decree-Law No. 9 of 2024. These amendments have not only increased penalties for employer violations but also enhanced the protections afforded to employees, ensuring stricter compliance with labour regulations and safeguarding workers' rights.

How Have the Penalties Changed

Previously, under Article 60 of the UAE Labour Law, penalties for employer violations ranged from AED 50,000 to AED 200,000. These penalties were imposed for offenses such as:

- Employing workers without proper authorization or licensing.

- Recruiting or employing workers and then leaving them without work.

- Misusing work permits for purposes other than those intended.

- Closing a business without settling workers' rights or entitlements.

- Employing minors in violation of the Labour Law.

- Agreeing to employ minors under guardianship in violation of the Labour Law.

The amendments introduced under Federal Decree-Law No. 9 of 2024 have significantly increased these penalties, with fines now ranging from AED 100,000 to AED 1,000,000. In addition to the increased fines, new provisions have been added to address fictitious employment practices. Offenses involving fictitious employment now carry severe fines, multiplied based on the number of workers involved. Employers are also required to reimburse the government for any financial incentives improperly obtained through such practices. This rigorous measure is aimed at ensuring that programs like Emiratisation are properly implemented and that employers do not attempt to circumvent related laws and regulations.

For employers, the amendments create a more stringent regulatory environment, demanding greater compliance with the Labour Law. How Does It Protect Employees and Their Rights?

The amendments to the UAE Labour Law significantly bolster employee protections in several ways:

- Increased Fines and Criminal Liability: The law dissuades employers from engaging in practices that could harm employees by significantly increasing fines and reinforcing criminal liability for violations.

- Extended Time-Bar for Claims: Extending the time-bar for bringing employment claims from one year to two years after termination provides employees with more time to claim unpaid dues, protecting their financial interests.

- MOHRE’s Enhanced Role: The Ministry of Human Resources and Emiratisation (MOHRE) plays a greater role in mediating disputes and issuing enforceable decisions in low-value claims. This ensures that employment disputes can be resolved more swiftly and efficiently, with lower legal costs.

- Wage Continuation During Disputes: The Labour Law protects employees' financial stability by authorizing the Ministry to instruct employers to continue wage payments during the dispute process, up to two months if their wages have been suspended.
