Vaping Indoors: A Rising Concern in the UAE

By Al Kabban & Associates

Recently, residents have voiced growing concern over the rise of indoor vaping in public spaces, from malls and gyms to airports and even aboard flights. Reports indicate that people increasingly disregard rules by vaping openly, especially in family-oriented environments. This shift has sparked both health fears and calls for stronger enforcement of existing laws.

What the Law Actually Says

Despite some perceptions of ambiguity, UAE law is clear:

  • Federal Law No. 15 of 2009 on Tobacco Control prohibits smoking and vaping in enclosed public spaces. Vaping indoors is only allowed in officially designated rooms that meet strict ventilation, isolation, and licensing criteria.
  • Enclosed spaces such as malls, offices, restaurants, cafés, airport terminals, and public transport are all covered by this ban.
  • Wadeema’s Law (Federal Law No. 3 of 2016) further protects children by outlawing vaping in the presence of minors or in vehicles when children under 12 are present.
  • Violations can attract immediate fines (around AED 500) for minor infractions, escalating to substantial fines and imprisonment, possibly ranging from AED 100,000 to AED 1,000,000 and up to two years in jail for repeat offenders or severe violations.

Enforcement is primarily overseen by authorities like Dubai Municipality, who have instructed malls and public venues to display signage, train security staff, and monitor compliance zones effectively.

Why Vaping Indoors Isn’t Harmless

Health professionals stress that vape aerosol is not merely harmless “water vapour.” It often contains nicotine, heavy metals, and other harmful chemicals. In confined areas like malls or gyms, vulnerable groups such as children or individuals with respiratory conditions can be affected by even brief second-hand exposure.

The normalization of vaping in shared spaces sends a worrying message: that such behavior is acceptable, or at least tolerated, in previously smoke-free environments.

Enforcement Gaps & the Case for Stronger Action

Despite clear laws, enforcement is inconsistent:

  • Some security personnel hesitate to intervene, considering vaping harmless compared to traditional smoking.
  • Fine levels, while established, may not be a strong enough deterrent for repeat offenders.
  • Surveillance in some areas remains lax.

A renewed, decisive push toward enforcement, comprising stepped-up inspections, increased penalties for repeat offenders, and broader awareness, could help preserve public order and protect communal health.

The rise of indoor vaping in the UAE reflects both changing habits and outdated perceptions. To preserve the UAE’s public spaces and safeguard health, it’s time for action, not just awareness.
