Enforcing UAE Court Judgments and Awards in 2025
In a thriving commercial hub like Dubai, legal clarity and enforceability are critical for protecting business and individual rights. Whether you’ve secured a victory in the Dubai Courts or through arbitration at the Dubai International Arbitration Centre (DIAC), the true test of justice lies in enforcement.
At Al Kabban & Associates—an award-winning law firm in Dubai with over 30 years of experience—we regularly assist clients in navigating the often complex, procedural aspects of judgment enforcement across the UAE. This article explains how to enforce judgments from both Dubai Courts and DIAC arbitration panels in 2025, and how to overcome the most common challenges.
1. The Legal Framework for Enforcement in the UAE
The enforcement of judgments and arbitral awards in the UAE is governed primarily by:
- Federal Civil Procedures Law (as amended)
- UAE Arbitration Law (Federal Law No. 6 of 2018)
- Dubai Judicial Authority Law (for DIFC-Dubai enforcement interplay)
- DIAC Arbitration Rules (updated in 2022)
Understanding where the original judgment or award was issued—and whether the enforcing party is located in Dubai, a free zone, or abroad—will dictate the steps needed to enforce it properly.
2. Enforcing Dubai Court Judgments
Once a party obtains a final and binding judgment from the Dubai Court of First Instance, it must follow several steps to begin enforcement:
Finality of Judgment
Before initiating enforcement, the judgment must be final and not subject to appeal. Exceptions apply in urgent cases, such as orders for precautionary measures.
Filing with the Execution Court
The case is transferred to the Execution Court, where the judgment creditor submits an application with the following:
- A copy of the final judgment
- Execution request form
- Emirates ID or commercial license
- Details of the debtor’s assets (bank accounts, real estate, vehicles)
Precautionary Measures
The Execution Court may issue orders to freeze the debtor’s assets—such as funds in bank accounts, property titles, or trade licenses—before collecting the awarded amounts.
Timeframe
The average time for enforcement depends on whether the debtor is cooperative. In contested cases, enforcement can take several months, particularly if assets need to be located or objections raised.
3. Enforcing DIAC Arbitration Awards in Dubai
While arbitration is faster and more confidential than court litigation, enforcement is still subject to court supervision.
Ratification by the Dubai Courts
Before an arbitral award from DIAC can be enforced, it must be ratified by the Dubai Courts (outside of the DIFC). This includes:
- Filing a petition for enforcement
- Submitting a certified copy of the award and arbitration agreement
- Proving that procedural fairness was upheld during arbitration
Common Grounds for Rejection
Even if you win an arbitration award, the court may reject enforcement if:
- The award violates UAE public order or morality
- The arbitrator lacked jurisdiction
- There was procedural misconduct or bias
Fast-Tracking in the DIFC
If the arbitration was seated in the DIFC, and the debtor has assets in Dubai or mainland UAE, the DIFC Courts can issue an enforcement order which can then be recognized and enforced by the Dubai Execution Courts via the Judicial Authority mechanism.
4. Foreign Judgments and Awards: A Cautionary Note
Enforcing foreign court judgments in the UAE can be more complicated. It depends on:
- The existence of bilateral treaties (e.g., with France, China, or GCC countries)
- Reciprocity of enforcement
- Whether the original court had jurisdiction
However, UAE courts are more likely to enforce foreign arbitral awards due to the UAE's accession to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards.
5. Strategic Advice from Al Kabban & Associates
Our litigation and arbitration team has handled hundreds of successful enforcement actions across Dubai and the UAE. Here’s what we recommend:
- Act Fast: Delays in enforcement can allow the debtor to hide or move assets.
- Secure Precautionary Measures early in the process to freeze movable and immovable property.
- Work with Enforcement Experts: A technical error or weak argument can derail the process.
- Use DIFC-Dubai Cross-Enforcement for strategically seated arbitrations.
