A Clear Jurisdictional Divide

In a move set to redefine how financial disputes between spouses are handled in Dubai, the Head of the Personal Status Court issued Decision No. 26 of 2025 on July 17, 2025. The decision outlines exactly which types of spousal financial claims fall under the jurisdiction of the Personal Status Court, and which do not.

The ruling clarifies that the Personal Status Court will only hear claims where one spouse has contributed to the construction, renovation, or modification of the marital home. These contributions may be in the form of financial investment, material provision, or similar involvement. Crucially, this jurisdiction applies regardless of the value of the contribution.

Any other form of financial dispute between spouses must now be referred to the appropriate civil court, which may include civil, commercial, or real estate courts, depending on the subject matter.

What Does This Mean for Married Couples?

Until this decision, it was not uncommon for spouses to attempt to resolve a wide range of financial disagreements, such as disputes over unpaid loans, traffic fines, shared business income, or co-owned properties, through the Personal Status Court. However, these types of claims no longer fall within the court’s remit.

Now, only matters involving the marital home itself will be handled within the personal status framework. Everything else, from business-related conflicts to unpaid debts between spouses, must be pursued through the UAE’s general civil court system.

This decision is part of a broader effort to ensure legal clarity and streamline the UAE judicial system. By drawing a firm line between personal and civil jurisdictions, Dubai courts aim to reduce procedural confusion and improve the speed and accuracy of case handling.
