Dispute Resolution for Citizen Housing Construction Contracts
In a landmark move to support housing development and safeguard the rights of UAE citizens, His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE and Ruler of Dubai, has issued a new law addressing the settlement of disputes arising from citizen housing construction contracts in the emirate.
The newly enacted legislation reflects Dubai’s continued commitment to social stability and citizen welfare by creating a streamlined mechanism to resolve contractual disputes without delaying critical housing projects.
Promoting Swift and Fair Resolution of Disputes
The law introduces a dedicated framework for alternative dispute resolution, allowing parties involved in citizen home construction contracts to resolve disagreements quickly, fairly, and without the cost and complexity of full litigation.
By prioritising amicable resolution, the law seeks to preserve contractual relationships and ensure that citizen housing projects proceed on schedule — a key factor in delivering homes to Emirati families in a timely and efficient manner.
Key Provisions:
- Specialised Mediation Branch:
A new branch will be established within the Centre for Amicable Settlement of Disputes (CASD) under Dubai Courts, exclusively handling disputes linked to citizen home building contracts. - 20-Day Mediation Window:
The CASD will attempt to mediate disputes within 20 working days, with a possible extension of another 20 days by mutual consent. - Expert Involvement:
Mediation will be conducted by specialist experts, ensuring technical accuracy and fair facilitation. - Fast-Track Adjudication:
If mediation fails, the matter proceeds to a three-member committee, comprised of one judge and two technical experts, which must issue a decision within 30 days, extendable once if necessary. - Appeal Rights:
Parties retain the right to appeal committee decisions before the Dubai Court of First Instance within 30 days of issuance.
Legal and Social Significance
The new law highlights Dubai’s push to integrate alternative dispute resolution (ADR) mechanisms into its legal framework, particularly in socially critical sectors like housing. It ensures that construction-related disagreements do not derail housing timelines, and empowers citizens with quicker access to justice.
Moreover, it strengthens public confidence in Dubai’s legal and judicial systems, reinforcing the emirate’s reputation for fair, efficient, and forward-looking governance.
Effective Date
The law comes into force on 1 January 2026, giving stakeholders sufficient time to understand and prepare for the new procedures.
