Hiring Domestic Workers in the UAE: When a Simple Mistake Can Cost AED 200,000+

By Al Kabban & Associates

A Cautionary Tale

Consider this: an expatriate household urgently recruits a nanny through an unlicensed agency because they want immediate assistance. Weeks later, MoHRE raids the home. The employer faces a fine of AED 200,000 and a suspended visa. This isn't hypothetical, it’s unfortunately all too common.

In the UAE, even seemingly minor shortcuts in hiring domestic help can lead to major legal exposure. Let’s unpack what the law says, why the penalties are so tough, and how navigating it correctly is absolutely essential.

Law in Focus: Federal Decree-Law No. 9 of 2022 on Domestic Workers and Updated Labour Regulations

Key provisions include:

  • Employing a domestic worker without a valid work permit or proper visa sponsorship can result in fines ranging from AED 50,000 up to AED 200,000.
  • Misuse of electronic portal credentials or working without a permit may attract fines between AED 200,000 and AED 1,000,000, plus up to 12 months imprisonment.
  • Repeat offences can multiply penalties, with maximums reaching AED 10 million when multiple workers are involved.

One of the most common mistakes is hiring a maid or nanny who resides in the UAE on her own visa or a freelance visa. While this may seem convenient, it is considered illegal under UAE labour law and can expose both the employer and the worker to the maximum range of penalties.

Why Is This Law So Strict?

The intent behind the legislation is multifold. First, it ensures that domestic workers have access to legal protections, including fair contracts, wages, insurance, and safe working conditions. Second, it aims to prevent the exploitation of a highly vulnerable segment of the workforce. And third, it enforces transparency by clamping down on the informal or black-market recruitment networks that often operate through social media or informal referrals.

The Ministry of Human Resources and Emiratisation (MoHRE) regularly conducts inspections of recruitment agencies and private homes. In 2025 alone, dozens of agencies were fined and had their licenses revoked for violations of the Domestic Workers Law. Employers are equally liable if found complicit or negligent.

Practical Checklist for Employers

Here are some key points that every household and employer should be aware of before hiring a domestic worker:

  • Use only licensed agencies to ensure full MoHRE compliance. Agencies must be authorized and regulated by the government.
  • Sponsor the worker’s visa directly. You, the employer, must be the official sponsor, not a third party or informal “broker.” Hiring a maid on someone else’s sponsorship is illegal.
  • Verify that the worker has a valid work permit and is medically insured before beginning employment.
  • Avoid hiring individuals with their own visa or on a freelance permit, even if they claim to be working independently. This setup does not meet legal requirements.
  • Never misuse previous permit numbers or portal credentials, which can result in fines or imprisonment for digital fraud.

When Things Go Wrong: What You Could Face

If you’re caught employing a domestic worker without following proper legal channels, the consequences can be significant.

  1. Labour file suspension: This can restrict your ability to sponsor new visas or conduct employment-related transactions.
  2. Heavy fines: Violations can lead to fines starting from AED 50,000 and rising up to AED 200,000 or more depending on the nature and frequency of the offence.
  3. Potential imprisonment: In serious cases involving fraud or portal misuse, employers can face jail time of up to one year.
  4. Deportation or visa cancellation: Both the worker and employer may be subject to deportation or permanent visa bans.

Even seemingly innocent arrangements, such as employing a helper part-time while she’s sponsored by another family, can lead to legal scrutiny and fines if discovered by authorities.
